Joshua Paul (Counsel)
Joshua Paul has more than thirty years’ experience as a litigator, strategic counselor, and transactional lawyer in the areas of trademarks, copyrights, design patents and related intellectual property matters. He is also an experienced commercial litigator in such areas as professional malpractice, antitrust, secured lending and commercial paper, and general business law. In 2007, Mr. Paul was elected a Fellow of the American Bar Foundation. The Fellows is an honorary organization of practicing lawyers, judges, and law professors whose careers reflect the legal profession’s highest principles. Membership in the Fellows is limited to one percent of all lawyers licensed to practice in each jurisdiction.
As a litigator of intellectual property disputes, Mr. Paul represents U.S. and global companies in trial and appellate court proceedings ranging from routine trademark infringement and counterfeiting cases, to complex, “bet-the-brand” disputes. His litigation work extends across many industries; among others, fragrance-cosmetics, pharmaceuticals, insurance-banking, celebrity licensing, and consumable consumer goods. Mr. Paul also represents clients in trademark registration proceedings before the Trademark Trial and Appeal Board of the U.S. Patent and Trademark Office. Mr. Paul enjoys a reputation as a litigator who manages cases within budget while staying focused on his client’s strategic and business objectives.
Mr. Paul has a multi-faceted intellectual property counseling and transactional practice on behalf of U.S. and global companies. He helps clients clear, register, and maintain trademark rights in the United States; handles trademark, copyright and product licensing; counsels manufacturers of branded products on implementing limited distribution strategies in the U.S., and on policing the U.S. market against counterfeits and unlawful “after-market” parts and parallel import (gray goods); and helps companies develop and implement anti-counterfeiting strategies through the U.S. Bureau of Customs and Border Protection, local and national law enforcement, and the courts.
Mr. Paul has served on the editorial boards of legal publications of national significance, including The Trademark Reporter and The Intellectual Property Strategist. He has chaired or co-chaired numerous subcommittees of the American Bar Association’s Litigation and Intellectual Property Law Sections dealing with anti-counterfeiting, electronic discovery, and legal ethics.
Mr. Paul is a graduate of Yale College (B.A. cum laude) and the Pritzker School of Law at Northwestern University (J.D.). He is a member of the New York Bar and is admitted to practice before the Supreme Court of the United States, the United States Court of Appeals for the Second Circuit, and the United States District Courts for the Southern and Eastern Districts of New York.
