Overview
Jeffrey Malsch concentrates his practice on civil litigation with an emphasis on products liability while also handling public nuisance, consumer fraud, mass tort, class action, premises liability, construction/labor law, and insurance coverage claims. He handles and supervises every aspect of these cases, from pre-suit investigations and initial pleadings through trial.
He focuses on the Firearms and Sporting Goods industries in many capacities, including the defense of manufacturers from product defect claims, preparation of product warnings and instructions, and advising on recalls. Mr. Malsch also has extensive experience defending firearms and ammunition sellers against claims of negligent entrustment or violations of law related to sales of their products and has achieved early dismissals pursuant to the Protection of Lawful Commerce in Arms Act, a federal immunity statute, and similar state laws. Mr. Malsch also frequently counsels Federal Firearms Licensees (FFLs) concerning BATFE compliance issues. Additionally, he has experience defending shooting ranges against claims of improper design and negligent procedures resulting in personal injury or property damage.
Mr. Malsch is licensed to practice law in New York and Connecticut. He appears as pro hac vice counsel in state and federal courts throughout the country and has tried cases to verdict in many New York State Supreme courts as well as state and federal courts in Texas, Arkansas and Michigan. He has argued before appellate courts in numerous jurisdictions achieving precedent setting opinions in New York, Alabama, Nevada and New Hampshire. He was recently on the brief in a United States Supreme Court unanimous victory in Smith & Wesson Brands, Inc. v. Estados Unidos Mexicanos, 605 U.S. 280 (2025).
Mr. Malsch earned his B.S. from the University of Vermont, majoring in Mathematics, and earned his J.D. from American University’s Washington College of Law.
