Overview
Scott C. Allan is a Senior Associate with the Firm. His practice areas include all aspects of civil defense litigation, at both the trial and appellate court levels. Scott has substantial experience in the defense of firearm manufacturers, importers, distributors and retailers in nationwide litigation involving claims of public nuisance and negligent marketing and distribution. He has been actively involved in obtaining the dismissal of these types of cases pursuant to the Protection of Lawful Commerce in Arms Act (“PLCAA”) since it was enacted in 2005.
Mr. Allan also has extensive experience in the defense of product liability cases in federal and state courts. He regularly advises clients with regard to product warning issues, and has worked on numerous instruction manuals for firearms and related products. Scott also counsels clients with regard to product recalls and Consumer Product Safety Act compliance.
Scott regularly provides counseling to clients regarding compliance with federal and state laws and regulations applicable to firearms and ammunition, including the Gun Control Act, National Firearms Act, Arms Export Control Act, and state restrictions on the manufacture and sale of firearms, including “assault weapon” bans and magazine capacity restrictions, and state laws regarding the adoption of “reasonable controls.” He frequently advises clients with regard to ATF licensing issues and related tax issues, including the Firearms and Ammunition Excise Tax, and payment of the special occupational tax and transfer taxes required by the National Firearms Act.
He also has experience with the defense of asbestos and toxic tort claims, and has represented several large corporations in the defense of asbestos cases throughout New York. He has advised clients with regard to compliance with California Proposition 65, regarding the disclosure of potentially harmful materials in products. He also has experience successfully litigating trademark infringement and cybersquatting cases.
Scott received his B.A. cum laude from Manhattanville College, where he was a triple major in History, English and Legal Studies. He then earned his J.D. magna cum laude from Pace University School of Law, where he was a member of the Pace Law Review. Prior to joining Renzulli Law Firm, LLP, Scott served as a Confidential Law Clerk for the Honorable John T. Elfvin, Senior United States District Judge, in the United States District Court for the Western District of New York.
