November 25, 2025 – Renzulli Law Firm (“RLF”) recently secured another victory on behalf of one of its firearms industry clients. The matter arose from an alleged unintentional discharge of a semi-automatic pistol while the plaintiff attempted to place it into a safe located in his closet. The plaintiff claimed that the pistol slipped from his hand and fired as he attempted to catch it, despite asserting that his finger never pulled the trigger. From the outset, RLF pursued a proactive defense. Prior to written discovery or depositions, RLF and its firearm consultant conducted a physical inspection of the pistol, which confirmed that the firearm operated exactly as designed, demonstrating that the pistol could not have discharged absent a trigger pull, contrary to the plaintiff’s theory.
Following the inspection, RLF advised plaintiff’s counsel in detail of the inspection results which conclusively refuted the plaintiff’s allegations and established that the pistol was functioning properly. Faced with this indisputable evidence, the plaintiff voluntarily dismissed the action with prejudice. This result underscores the strategic importance of an early evidence inspection in products liability matters, as a prompt evaluation of the product can yield decisive proof. RLF’s early and aggressive strategy avoided unnecessary and protracted litigation and secured a favorable outcome for the client.
