David Massey is Senior Counsel with Renzulli Law Firm.  Mr. Massey concentrates on civil litigation primarily in highly regulated industries.  He works closely with the firearms litigation team defending manufacturers, distributors and dealers against a wide array of claims including nuisance, consumer product statutes, product liability, negligence and many others. He has also advised clients in virtually every kind of litigation, including MDLs, class actions, receivership actions, product liability, intellectual property, COVID-19 litigation, domestic and international distributor terminations, and a myriad of breach of contract, tort, and antitrust actions.  

Mr. Massey served as a Sergeant in the United States Marine Corps, including as a light armored vehicle commander and anti-tank gunner in Iraq during the invasion in 2003, where he received a rare meritorious combat field promotion.  He has also received various awards and decorations, including the Presidential Unit Citation, National Defense Medal, Iraq Campaign Medal, Global War on Terrorism Service Medal, Sea Service Deployment Award, Marine Corps Good Conduct Award, Marine Corps Armed Forces Reserve Medal, Meritorious Mast, and five-time Rifle Expert.

Mr. Massey served as a judicial clerk for the Honorable K. Michael Moore, United States District Court for the Southern District of Florida.  He also served as a judicial intern for the Honorable Henry B. Pitman (S.D.N.Y), the Honorable David G. Trager (E.D.N.Y.), and the Honorable Deborah A. Kaplan (N.Y. Supreme Court).

Mr. Massey earned his J.D. from Fordham University School of Law and his B.S. from the University of Utah, majoring in Finance and Political Science.

  • Represented T-Mobile in receivership action seeking over $2.5B in losses by investors in a Ponzi scheme.
  • Represented CIGNA in MDL and subsequent arbitration and federal litigation concerning provider reimbursement of over 600,000 medical services totaling nearly $1B.
  • Represented hedge fund in action seeking $1.2B from defaulted loan made by a conglomerate of New York banks.
  • Represented Bacardi in the largest realignment of alcohol beverage distribution in the history of the United States since prohibition, with total claims in excess of $3B.
  • Represented Carnival Cruise Lines in commercial dispute over commissions with total claims in excess of $1B.
  • Represented Winston & Strawn in professional negligence suit brought by a receiver seeking over US$100M in damages.
  • Represented private alcohol beverage company in dispute concerning distribution contract with claims in excess of $250M.
  • Represented pineapple grower in Costa Rica against Del Monte concerning termination of pineapple supply contract amounting to over $50M in claims.
