September 23, 2013:

Colorado:  The Rocky Mountain Gun Owners have filed the second suit this year in Colorado challenging Colorado’s new background check laws and magazine capacity restrictions.  The suit was filed on September 4th in the District Court for the City and County of Denver and asks the Court to find the new laws unconstitutional under the Colorado State Constitution.  The complaint (available here) asserts that the new laws violate Article II, Section 13 of the Colorado Constitution (right to keep and bear arms) as well as the due process and equal protection clauses of the Colorado Constitution.  The complaint further asserts that the statutes constitute an unconstitutional delegation of executive authority and legislative power.

New Jersey:  A3797 is now headed back to the Governor’s desk after the proposed revisions contained in the Governor’s conditional veto last month passed the Assembly and the Senate. The bill imposes various trace reporting requirements on law enforcement any time a firearm is recovered, including requiring them to provide information to Federal databases.  Despite the movement on A3797, legislators have taken no steps with respect to S2723–the other firearms bill that was conditionally vetoed by the Governor last month.  Although legislators could still consider approving the Governor’s gutted version of S2723, it is likely to remain dormant given that the Governor vetoed the primary provisions of the bill which would have imposed numerous additional restrictions and requirements on purchasing firearms.
